Terms of Service
Welcome to Aura Solar. By using our website and services, you agree to the following Terms of Service ("Terms"). Please read these Terms carefully. If you do not agree to these Terms, you must not use our services.
1. Overview Aura Solar ("Company," "we," "us," "our") provides solar energy solutions to residential and commercial customers in Dallas, Texas, and surrounding areas. These Terms govern your access to and use of our services, including but not limited to consultations, solar installations, maintenance, and any other services offered by Aura Solar.
2. Eligibility By using our services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding contract under applicable law. You also agree to provide accurate and complete information during the service request process.
3. Services Provided Aura Solar offers solar panel installation, consultation, maintenance, and repair services. The scope of each service will be outlined in a service agreement provided to you before any work begins.
4. Service Agreements Each customer will receive a personalized service agreement outlining the specific services, costs, and terms applicable to their project. By signing the service agreement, you agree to be bound by its terms, which may include additional terms and conditions beyond what is outlined in these Terms.
5. Pricing and Payment The pricing for our services is based on your service agreement. All payments are due as outlined in the agreement. Failure to make timely payments may result in suspension or termination of services. We reserve the right to adjust pricing based on project specifics, market conditions, or changes in the scope of work.
6. Cancellations and Refunds If you need to cancel a scheduled service, you must notify us at least 48 hours in advance. Cancellations made within this period will be eligible for a full refund. Cancellations made less than 48 hours in advance may be subject to a cancellation fee. Refunds for canceled projects will be handled according to the terms in your service agreement.
7. Service Limitations Our solar energy solutions are designed based on the specific needs of each customer. However, we cannot guarantee energy production levels due to variables such as weather conditions, shading, and site-specific factors. Aura Solar is not liable for disruptions in energy production caused by factors beyond our control.
8. Intellectual Property All materials, logos, designs, and content provided by Aura Solar, whether on our website or in physical form, are owned by Aura Solar or licensed to us. You are not permitted to use any of our intellectual property without our prior written consent.
9. Warranty and Maintenance Aura Solar provides warranties on solar installations, which will be detailed in your service agreement. These warranties typically cover equipment defects and installation workmanship for a specific period. Regular maintenance is recommended to keep your solar system in optimal condition.
10. Limitation of Liability Aura Solar shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of revenue, data, or profits, arising from your use of our services. Our total liability for any claim related to our services will be limited to the amount paid for the service in question.
11. Indemnification You agree to indemnify, defend, and hold harmless Aura Solar and its employees, officers, and affiliates from any claims, damages, liabilities, or expenses (including attorney fees) arising from your breach of these Terms or any violation of applicable laws or regulations.
12. Dispute Resolution Any disputes arising out of or related to these Terms or the services provided by Aura Solar will be resolved through binding arbitration in Dallas, Texas, under the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.
13. Governing Law These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
14. Changes to Terms We reserve the right to modify these Terms at any time. Any changes will be effective upon posting on our website. Your continued use of our services after such changes constitutes your acceptance of the revised Terms.
